Terms and Conditions

These OAD Travel Terms of Use (these “Terms”) apply to your access or use of the OAD Travel websites, mobile sites, and applications (collectively, the “OAD Travel Sites”) and the content, features, and services (the “Services”) made available by the relevant Substantial Leisure Company, dba “OAD Travel”.

In these Terms, “OAD Travel” and “we” mean the entity that is providing the Services to you, and with whom you are entering into these Terms, which depends on the country in which you reside. The terms “User” and “you” mean any user of the Services. These Terms incorporate OAD Travel’s standard policies, procedures, and terms and conditions for use of the Services that are referenced by name or by links in these Terms (collectively, the “OAD Travel Policies”).

By accessing or using the Services or by clicking “accept” or “agree” to these Terms, (1) you acknowledge that you have read, understand, and agree to be bound by these Terms, and (2) you represent and warrant that you are of legal age and not prohibited by law from accessing or using the Services.

We may modify these Terms at any time in our sole discretion. We indicate at the top of the page when these Terms were last modified or updated. Your continued access or use of the OAD Travel Sites and/or your Account (as defined below) following such changes constitutes and signifies your full acceptance of such changes. If we make material changes to the Terms, we will notify you through a notice on the OAD Travel Sites homepage and/or an email. You are responsible for periodically visiting the OAD Travel Sites and the Terms to check for any changes. If you choose to opt-out of our revised Terms, you must stop accessing and using the OAD Travel Sites immediately. We may also modify the OAD Travel Sites at any time in our sole discretion by removing from, adding to or modifying the site. We shall have no liability to you for any such modifications. Your continued access or use of the OAD Travel Sites and/or your Account (as defined below) following such changes constitutes and signifies your full acceptance of such changes.

In these terms, a “Package” means the pre-arranged combination of one or several of the following components: (a) restaurant; (b) hotel accommodation; and (c) other tourist services, which may be acquired by Users at the OAD Travel Site.

The suppliers delivering the restaurant and/or accommodation services included in the OAD Travel Packages (the “Suppliers”) work in accordance with their own terms and conditions, which will also form part of these Terms. Some of those terms and conditions may limit or exclude the Supplier's liability to you, usually in accordance with applicable International Conventions.

  1. RESERVATIONS

    OAD Travel makes available Package reservation services (the “Reservation”) through the OAD Travel Sites to User for the purpose of assisting User in securing dining and hotel room reservations from Suppliers, as included in the Packages. In response to a User’s online request for a Package reservation through the OAD Travel Sites, OAD Travel shall manage such reservations with the relevant Suppliers’ database or other method of reservations and shall be subject to availability at such time.

    OAD Travel cannot and does not guarantee the availability of any restaurant or hotel room(s) reservations for a given trip itinerary until OAD Travel has provided express written confirmation notice to the User, which shall be provided via email to the address registered in the relevant User account.

    In any case, all Reservations will be subject to the execution of the Initial Payment, as foreseen in Section 2, and will not be confirmed or deemed final until such payment has been confirmed to OAD Travel.

  2. PRICING AND PAYMENT OF A RESERVATION

    Pricing for Reservations is variable and depends on a number of factors, including but not limited to the restaurants and accommodations included in the Package, the time and day of the week of such accommodations and the type of menus, rooms or other options selected (where applicable). Suppliers and OAD Travel may change the pricing for and availability of any Package at any time with or without notice, including adding additional Packages.

    All Restaurant reservation and hotel room(s) reservations shall be paid in advance as follows:

    1. In order to proceed with a Reservation, you need to submit your credit card details to your Account. Please be advised that until your details are submitted, the Package you are considering can be purchased by another User.
    2. Your card will not be charged until all of your Packages and/or Suppliers’ selections have been confirmed. In the event that one or more of your selections are unavailable, you will be offered alternative options or you may opt not to proceed with the Reservation.
    3. Upon confirmation of your selections, your card will be charged for the total cost of the restaurant (food and beverages) for your trip plus 50% of the cost of your hotel accommodation (the “Initial Payment”). The balance will be charged 60 days before your first date of travel (the “Final Payment”). For trips purchased within 75 days of a trip’s start date, the full amount for Suppliers will be charged upon confirmation.

    You must make payments for your Reservation(s) in accordance with the instructions given in the OAD Travel Sites or otherwise communicated to you by OAD Travel.

    You acknowledge and agree that, given the nature of the Packages, all Reservations upon confirmation by OAD Travel will become final, non-refundable, and non-exchangeable, except as to any transferability or modifications that OAD Travel may expressly provide to Users according to Section 11 of these Terms. Before you complete a Reservation, you are responsible for reviewing the cancellation policy. All purchases are subject to OAD Travel’s service fees and charges, which are also non-refundable.

    Reservations may be subject to value added taxes or other taxes and charges depending on the location of the Supplier, the restaurant or the hotel, or the location from where you are accessing the OAD Travel Sites.

    OAD Travel accepts several methods of payment to accommodate your needs. OAD Travel reserves the right to (i) honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code or other similar promotions; (ii) ban any User from making any or all Reservations; and (iii) refuse to provide any User with any certain Package or accommodation.

    Should OAD Travel not receive any of the referred payments in full in due time, we reserve the right to treat your Reservation as cancelled by you.

  3. CANCELLATION, NO-SHOW, OR OTHER NON-FULFILLMENT BY USER

    Unless expressly indicated, all Reservations shall have a no-refund policy and, in relation thereto, you acknowledge and agree that any payment which has been made to OAD Travel with regard to any Reservations is final and non-refundable, and trip dates cannot be rescheduled. OAD Travel shall have no obligation to issue a refund in the event that User is unable to honor all or part of their booked Package, even if such inability is due to travel difficulties, including vehicle breakdowns or mechanical issues, or delays or cancellations imposed by airline or rail carriers.

  4. CANCELLATION BY OAD TRAVEL

    OAD Travel reserves the right to cancel the Reservation in case of:

    1. Force Majeure; and
    2. No fulfillment or failure of payment on any of the due payments for a Reservation.

    In the event of any cancellation under the abovementioned conditions, you acknowledge that you will have no right of cash refund of the paid price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement, or delay. Notwithstanding the foregoing, in the event of the inability of User to receive Services in a booked Package due to closure of the Supplier not resulting from Force Majeure, and not due to any fault of User, User may be eligible for a refund, but only for the fair value of the specific Services not received.

    For these purposes, Force Majeure shall include any event which we or the Supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid and which restrict or hinder our ability to provide the services. These events can include, but are not limited to, war, threat of war, civil strike, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the Supplier(s) concern’s control.

  5. PARTICULAR REQUESTS

    Special requests, such as preferences, food allergies, dietary restrictions, food dislikes, or changes in the Reservation (e.g., from lunch to dinner), must be addressed directly to the relevant Suppliers. Since we will not be involved in providing the reserved menus and/or accommodations, OAD Travel shall have no responsibility for and will not be involved in addressing or resolving any such issues. A failure to meet any special request will not be a breach of contract on our part or entitle the User to any partial or total refund.

    The Package will include a credit for Suppliers’ Services in the amount specified in the Package. In case the User decides to add other beverages, foods, or other articles or services to the menu/accommodation which are not included within the Reservation, the User will pay the relevant Supplier directly for such items.

  6. YOUR ACCOUNT

    You shall create an account with OAD Travel through the OAD Travel Sites (“Account”) in order to use the Services and to process the Initial Payment and Final Payment. When registering for an Account, you must provide true, accurate, current, and complete data about yourself on the OAD Travel registration form (“Registration Data”). You also agree to promptly update the Registration Data to keep it true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your Account and the information in your Account, and, except as otherwise required by applicable law, you are solely responsible for all use of your Account, whether or not authorized by you. You agree to immediately notify OAD Travel of any unauthorized use of your Account or any other breach of security related to your use of the Services.

  7. THIRD-PARTY WEBSITES

    If you click on a link to a third-party website, you will leave the OAD Travel Sites and go to the website you selected. We do not own or operate any third-party websites, and we have not reviewed, and cannot review, all of the material, including goods or services, made available through such third-party websites. The availability of these links on this Site does not represent, warrant or imply that we endorse any third-party websites or any materials, opinions, goods or services available on them. Third-party materials accessed through or used by means of the third-party websites may also be protected by copyright and other intellectual property laws. These Terms do not apply to third-party websites. Before visiting a third-party website by means of this Site or a link located on this Site, Users should review such third-party website’s terms and conditions, privacy policy, and all other website documents, and inform themselves of the regulations, policies, and practices of such third-party website. You agree that OAD Travel shall have no liability for, and you hereby release OAD Travel from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of any third-party website.

  8. COMMUNICATIONS FROM OAD TRAVEL

    If you use OAD Travel Sites and Services, OAD Travel may communicate with you via electronic messages, including email, text message/SMS, or mobile push notifications in accordance with our privacy policy as set forth in Section 13 of these Terms.

  9. TECHNICAL REQUIREMENTS

    Use of the Services requires internet access through your computer or mobile device. You are responsible for all mobile carrier data or text message charges resulting from your use of the Services, including from any notifications provided by the Services. In order to use the text message-based services, you must maintain an active Account with a carrier of electronic communications through mobile devices. OAD Travel does not guarantee that the Services will be compatible with all devices or will be supported by all mobile carriers.

  10. CHANGES ON A RESERVATION

    1. Changes by User

      Except as expressly permitted, no changes are allowed to your Reservations after Initial Payment has been confirmed in accordance with Section 2.

      Reservations are transferrable to other Users, but only as expressly permitted or in accordance with Section 11 of these Terms.

    2. Changes by OAD Travel

      Because we plan our Packages many months in advance, in some circumstances we reserve the right to make changes to Reservations.

      Most changes will be minor, and while we will do our best to notify them to you as soon as reasonably possible before your Package starting date, we will have no other liability to you in respect of them.

      Examples of “Minor Changes” made before departure include the following:

      • A change in the price or composition of the contracted menus of the restaurants, due to a change implemented by the restaurant to their available menus.
      • A change of accommodation to another hotel of the same standard or classification.

      Occasionally we may have to make a major change to your Reservations. Examples of “Major Changes” made before departure include the following:

      • A change of reservation to another restaurant of a lower standard or classification.
      • A cancellation of one of the restaurants reserved with no replacement of a restaurant of a similar standard or accommodation.
      • A change of accommodation to that of a lower standard or classification for the whole or a significant part of your time away.

      If we have to make a Major Change or cancel, we will tell you as soon as possible and if there is time to do so before the starting date, we will offer you the choice of:

      1. Accepting the changed arrangements;
      2. Having a refund of all payments effectively executed; or
      3. Accepting an offer of alternative arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value, the same way you will incur in extra costs if the alternative is of a higher value).

      You must notify us of your choice within 5 days of our offer, unless the trip starting date is sooner or if an earlier decision is required according to Suppliers policy or other providers’ requirements in which case, we might request an answer within a tighter timeframe. If you fail to do so we will assume that you have chosen to accept the change or alternative arrangements.

  11. TRANSFER OF A RESERVATION

    Users shall be entitled to transfer the Reservation to another User at any time up to two weeks before the start date of the booked Package. Such transfer shall be carried out in strict accordance with the instructions and processes provided in the OAD Travel Sites or as otherwise communicated to you by OAD Travel. No change shall be made to the Reservations, and the Reservations will need to be transferred in full. Transfers shall only be valid if made to registered Users of OAD Travel. OAD Travel shall be free to deny a Reservation transfer if it considers it is being done in breach of these Terms.

  12. INTELLECTUAL PROPERTY RIGHTS AND GRANT OF RIGHTS TO USER

    The features, information, and materials provided and depicted through the Services and/or OAD Travel Sites are protected by copyright, trademark, patent, and other intellectual property laws. All text, graphical content, video, data, and other content made available through the Services and/or OAD Travel Sites (collectively, the “OAD Travel Content”) are provided to User by OAD Travel or its partners or licensors solely to support User’s permitted use of the Services. The OAD Travel Content may be modified from time to time by OAD Travel in its sole discretion. Except as expressly set forth herein, no license is granted to User for any other purpose, and any other use of the Services or the OAD Travel Content by User shall constitute a material breach of these Terms. OAD Travel and its partners or licensors retain all rights in the Services and OAD Travel Content and any associated patents, trademarks, copyrights, mask work rights, trade secrets, or other intellectual property rights. No license, right, or interest in any trademarks of OAD Travel or any third party is granted under these Terms.

  13. PRIVACY POLICY

    OAD Travel is committed to helping you safeguard your privacy online. Please review our privacy policy for details about how we collect, use, and disclose information in connection with the Services here.

  14. USE RESTRICTIONS

    The Services and OAD Travel Content are offered solely for User’s personal use for the purposes described in these Terms. Any and all other uses are prohibited. OAD Travel expressly reserves all its rights and remedies under applicable laws. OAD Travel reserves the right, in its sole discretion, to refuse service, terminate Accounts, remove or edit content, cancel reservations, or deny access to the Services. You agree not to (and not to allow any third party to): (1) use any deep-link, robot, spider, scraper, or other automatic or manual device, process, or means to access, copy, search, or monitor any portion of the Services or OAD Travel Content, except as expressly authorized by OAD Travel; (2) use any portion of the OAD Travel Site content to provide, or incorporate any portion of the Services or OAD Travel content into, any product or service provided to a third party; or (3) use the Site or OAD Travel content for any illegal purpose. Although the OAD Travel Sites may be accessible worldwide, not all features or services discussed, referenced, provided, or offered through or on the OAD Travel Sites are available to all persons or geographic locations, or are appropriate or available for use in your jurisdiction. OAD Travel reserves the right to limit, in its sole discretion, the provision and quantity of any feature or service to any person or geographic area.

  15. MODIFICATIONS & TERMINATION

    OAD Travel may alter or suspend your ability to use all or any element of the Services or may modify or terminate these Terms effective immediately, without notice or explanation. Without limiting the foregoing, OAD Travel may suspend your access to the Services if we believe you to be in violation of any part of these Terms (including any OAD Travel Policies). After any suspension or termination, you may or may not be granted permission to use the Services or re-establish an Account. You agree that OAD Travel shall not be liable to you for any termination of these Terms or for any effects of any termination of these Terms. You are always free to discontinue your use of the Services at any time. You understand that any termination of your Account may involve deletion of any content stored in your Account for which OAD Travel will have no liability whatsoever.

  16. REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

    The Services may permit you to submit, transmit, post or otherwise provide content, including, but not limited to, reviews, comments, ratings, photos, images, videos, sounds, text, data, links and location information; send emails and other communications; and submit suggestions, ideas, comments, questions, or other information (“User Content”). Any such User Content must not be illegal, threatening, obscene, racist, defamatory, libelous, pornographic, infringing of intellectual property rights, promoting of illegal activity or harm to groups and/or individuals, invasive of a third party’s publicity or privacy rights, purposely false or otherwise injurious to third parties, or objectionable and must not consist of or contain software, computer viruses, commercial solicitation, political campaigning, chain letters, mass mailings, any form of “spam” or references to illegal activity, malpractice, purposeful overcharging, false advertising, or health code violations (e.g., foreign objects in food, food poisoning, etc.). Your User Content should be unbiased and objective. OAD Travel reserves the right (but has no obligation) to monitor, remove, or edit User Content in OAD Travel sole discretion, including if User Content violates these Terms (including any OAD Travel Policies), but you acknowledge that OAD Travel may not regularly review submitted User Content. If you do submit User Content, and unless we indicate otherwise, you grant OAD Travel a nonexclusive, perpetual, royalty-free, irrevocable, and fully sublicensable (through multiple tiers, including to restaurants, partners and other third party websites and feeds) right to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, display, and otherwise exploit such User Content throughout the world in any media, and, where applicable, you hereby waive any privacy or publicity rights or any similar rights in an individual’s name or likeness in addition to any moral or other rights you may have in the User Content you submit in favor of OAD Travel. You represent that you own, or have the necessary permissions to use and authorize the use of User Content as described herein. OAD Travel takes no responsibility and assumes no liability for any User Content submitted by you or any other User or third party, nor do we guarantee any confidentiality with respect to User Content.

  17. YOUR REPRESENTATIONS AND INDEMNITY

    You represent and warrant that you own or otherwise control all of the rights to any User Content submitted by you; that all User Content submitted by you is accurate; and that exploitation of such User Content by OAD Travel and its other Users, partners, and licensees will not violate these Terms, cause injury to any person or entity, or infringe any third-party rights (including, without limitation, intellectual property rights and rights of privacy or publicity). You will indemnify, hold harmless, and (at OAD Travel’s request) defend OAD Travel, its affiliates, and its and their representatives, agents, directors, managers, officers, employees, and shareholders (collectively, the “OAD Travel Parties”) from and against all claims resulting from (1) any User Content submitted by you, (2) your use of the Services, or (3) any breach or alleged breach by you of these Terms.

  18. LIABILITY LIMITATIONS

    EXCEPT AS EXPRESSLY SPECIFIED HEREIN, IN NO EVENT SHALL OAD TRAVEL BE LIABLE FOR ANY INJURIES, LOSSES, CLAIMS, OR DIRECT DAMAGES OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHICH ARISE OUT OF OR ARE ANY WAY CONNECTED WITH (1) THESE TERMS (INCLUDING ANY CHANGES THERETO), (2) ANY USE OF THE OAD TRAVEL SITES, SERVICES, THE OAD TRAVEL CONTENT, OR THE USER CONTENT, (3) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO, THE USE OR INABILITY TO USE ANY COMPONENT OF ANY OF THE SERVICES, SUCH AS INABILITY CAUSED BY TRAVEL DIFFICULTIES, INCLUDING VEHICLE BREAKDOWNS OR MECHANICAL ISSUES, OR DELAYS OR CANCELLATIONS IMPOSED BY AIRLINE OR RAIL CARRIERS, OR (4) YOUR VISIT TO ANY SUPPLIER OR THE PERFORMANCE, NON-PERFORMANCE, CONDUCT, OR POLICIES OF ANY SUPPLIER IN CONNECTION WITH THE SERVICES. IN ADDITION, YOU SPECIFICALLY UNDERSTAND AND AGREE THAT OAD TRAVEL SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES ASSOCIATED WITH ANY FOOD-INDUCED ILLNESS OR "FOOD POISONING" CAUSED BY SUPPLIERS AND DOES NOT GUARANTEE THE LEVEL OF PERFORMANCE OF ANY SUPPLIER. OAD TRAVEL IS NEITHER AN AGENT OF NOR OTHERWISE ASSOCIATED WITH ANY SUPPLIER FOR WHICH A USER HAS MADE A RESERVATION. IF YOU ARE A RESIDENT OF THE UNITED KINGDOM OR EUROPEAN UNION, THE LIMITATION OF LIABILITY IN THESE TERMS SHALL NOT APPLY TO ANY DAMAGE ARISING FROM OUR WILLFUL MISCONDUCT AND GROSS NEGLIGENCE, NOR SHALL IT APPLY TO DAMAGE FROM INJURY TO LIFE, BODY OR HEALTH.

    IF THE DISCLAIMER OF DIRECT DAMAGES ABOVE IS NOT ENFORCEABLE AT LAW, YOU EXPRESSLY AGREE THAT OUR LIABILITY TO YOU (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION) WILL AT ALL TIMES BE LIMITED TO A MAXIMUM OF THE PRICE ACTUALLY PAID BY THE USER AND RECEIVED BY OAD TRAVEL.

    You and OAD Travel understand and agree that the disclaimers, exclusions, and limitations in this Section 18 and in Section 19 are essential elements of these Terms and that they represent a reasonable allocation of risk. In particular, you understand that OAD Travel would be unable to make the Services available to you except on these terms and agree that these Terms will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.

  19. DISCLAIMERS

    You understand that use of the OAD Travel sites is at your own risk and OAD Travel cannot guarantee that the sites and or their content will be uninterrupted or error-free. The sites, all OAD Travel content, and any other information contained in or accessed through the sites, are provided to user on an “as is” basis and without warranty of any kind. OAD Travel expressly disclaims all representations, warranties, conditions, or indemnities, express or implied, including, without limitation, any warranty of merchantability, fitness for a particular purpose, title, or non-infringement, or any warranty arising from a course of dealing, performance, or trade usage. OAD Travel does not warrant that your use of the services will be uninterrupted or error-free, that OAD Travel will review the information or materials made available through the Site for accuracy or that it will preserve or maintain any such information. OAD Travel shall not be liable for delays, interruptions, service failures, or other problems inherent in use of the internet and electronic communications or other systems outside the reasonable control of OAD Travel.

    The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights. However, the duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by law.

  20. RELEASE

    OAD Travel is an intermediary between Suppliers and you. Suppliers are solely responsible for their interactions with you and any and all claims, injuries, illnesses, damages, liabilities, and costs (“Claims”) suffered by you as a result of your interaction with or visit to any Supplier or from any promotion, offer, product or service of any Supplier. Users must resolve all disputes directly with Supplier. To the maximum extent permitted by applicable law, you hereby release the OAD Travel Parties from any and all such Claims. You hereby expressly waive and relinquish all rights and benefits under these Terms and any law of any jurisdiction of similar effect with respect to the release of any unknown or unsuspected claims you may have against the OAD Travel Parties pertaining to the subject matter of this Section 20. If you are a resident of the United Kingdom or European Union, this release shall not apply to any damage arising from our willful misconduct or gross negligence, nor shall it apply to damage from injury to life, body or health.

    IN THIS REGARD, YOU SPECIFICALLY UNDERSTAND AND AGREE THAT OAD TRAVEL SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES ASSOCIATED WITH ANY FOOD-INDUCED ILLNESS OR "FOOD POISONING" CAUSED BY SUPPLIERS AND DOES NOT GUARANTEE THE LEVEL OF PERFORMANCE OF ANY SUPPLIER. OAD TRAVEL IS NEITHER AN AGENT OF NOR OTHERWISE ASSOCIATED WITH ANY SUPPLIER FOR WHICH A USER HAS MADE A RESERVATION. IF YOU ARE A RESIDENT OF THE UNITED KINGDOM OR EUROPEAN UNION, THE LIMITATION OF LIABILITY IN THESE TERMS SHALL NOT APPLY TO ANY DAMAGE ARISING FROM OUR WILLFUL MISCONDUCT AND GROSS NEGLIGENCE, NOR SHALL IT APPLY TO DAMAGE FROM INJURY TO LIFE, BODY OR HEALTH.

  21. COMPLAINTS

    If you experience a problem during your visit to any Supplier, please immediately inform the relevant Supplier so that they can take steps to put things right.

    If your complaint remains unresolved and you wish to complain further, please send written notice of your complaint to us using the Contact Us form on our website or by emailing us at info@oadtravel.com within 15 days of the incident, giving your booking reference and all other relevant information. Failure to follow the procedure set out in this Section may affect ours and the applicable Supplier’s ability to investigate your complaint and could affect your rights under our Terms.

  22. SEVERABILITY

    If any of the provisions, or portions thereof, of these Terms are found to be invalid under applicable law, that provision (or portion thereof) notwithstanding, these Terms shall remain in full force and effect and such provision or portion thereof shall be deemed omitted.

  23. ASSIGNMENT

    These Terms and the rights granted and obligations undertaken hereunder may not be transferred, assigned, or delegated in any manner by User, but may be freely transferred, assigned, or delegated by OAD Travel.

  24. WAIVER

    Any waiver of any provision of these Terms, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right.

  25. JURISDICTION AND APPLICABLE LAW

    The applicable law in case of dispute or conflict of interpretation of the Terms, as well as any matter related to the Services, will be Spanish law.

    For the resolution of any dispute that may arise from these Terms or the Services, the parties agree to submit to the jurisdiction of the Courts and Tribunals of the city of Barcelona (Spain), and their hierarchical superiors, expressly waiving other jurisdictions if they have and were different from those outlined.

  26. PASSPORT, VISA AND IMMIGRATION REQUIREMENTS AND HEALTH FORMALITIES

    It is your responsibility to check and fulfill the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change and you must check the up to date position in good time before departure. Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting.

    We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses that we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.
